Terms of Service

By accessing, downloading, or using the Lushme application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Lushme ("we," "us," or "our"). Your continued use of the Service after any modifications to these Terms constitutes acceptance of those changes.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our Service and updating the "Last Updated" date. It is your responsibility to review the Terms periodically.

You must be at least 18 years of age to create an account and use Lushme. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Lushme is a social networking platform intended exclusively for adults. We do not knowingly collect information from or direct our Service to anyone under 18. If we learn that a user is under 18, we will terminate their account immediately and delete all associated data.

By using Lushme, you further represent that you are not prohibited from using the Service under the laws of your jurisdiction, that you have not been convicted of any felony or sex-related offense, and that you are not required to register as a sex offender with any governmental authority.

To use certain features of the Service, you must create an account by providing accurate, current, and complete information. You agree to update your information promptly if it changes.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us at support@lushme.app if you suspect any unauthorized use of your account.

You may not create more than one account per person. You may not transfer, sell, or assign your account to any other individual. We reserve the right to disable any account that we reasonably believe violates these Terms.

Lushme may offer account verification methods (such as phone number verification or photo verification) to enhance trust and safety. Providing false verification information is grounds for immediate account termination.

You are solely responsible for all content that you upload, post, share, or otherwise make available through the Service ("User Content"), including profile photos, biographical information, and messages.

By posting User Content, you grant Lushme a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, display, reproduce, modify, and distribute your User Content solely in connection with operating and improving the Service. This license ends when you delete your content or account, except where your content has been shared with others and they have not deleted it.

You represent and warrant that you own or have the necessary rights to all User Content you post, and that your content does not violate the rights of any third party, including intellectual property, privacy, or publicity rights.

All profile information must be truthful and represent you accurately. Impersonating another person or creating a misleading profile is strictly prohibited.

The following are strictly prohibited on Lushme and will result in account suspension or permanent termination:

Harassment, bullying, intimidation, or threats of violence against any user. This includes unwanted persistent contact after a user has indicated they are not interested.

Creating fake, misleading, or fraudulent profiles, including using someone else's photos or identity. Catfishing in any form is not tolerated.

Solicitation of money, financial scams, phishing, or any form of fraud. This includes advance-fee schemes, romance scams, and cryptocurrency solicitation.

Posting, sharing, or soliciting sexually explicit content, pornography, or nude imagery. Lushme is not an adult content platform. Intimate content shared without the subject's consent is strictly prohibited and may be reported to law enforcement.

Hate speech, discrimination, or content promoting racism, sexism, homophobia, transphobia, or any other form of bigotry.

Spam, commercial solicitation, advertising, or promotion of third-party services or products without our prior written consent.

Uploading malicious software, engaging in hacking, data mining, scraping, or any activity that compromises the security or integrity of the Service.

Stalking, doxxing, or sharing another user's personal information without their consent.

Any illegal activity, including but not limited to drug trafficking, human trafficking, prostitution, or exploitation of minors.

Lushme facilitates connections between users based on mutual interest and consent. Messaging and interaction features are designed to be used respectfully and in good faith.

You may only send messages to users who have mutually matched with you or otherwise consented to receive communication from you. Unsolicited messages through circumvention of platform controls are prohibited.

You must respect other users' boundaries at all times. If a user blocks you, unmatches with you, or asks you to stop communicating, you must immediately comply. Attempts to circumvent blocks or contact users through alternative accounts are grounds for permanent termination.

Lushme reserves the right to monitor, review, and remove messages that violate these Terms or our Community Guidelines. While we strive to maintain a safe environment, we cannot guarantee that all communications will be free from objectionable content.

You acknowledge that interactions with other users are at your own risk. Lushme does not conduct criminal background checks on users and makes no representations or warranties regarding the conduct, identity, or compatibility of any user.

Lushme may offer premium subscription plans and virtual currency systems (such as Coins or Jetons) that provide access to enhanced features including, but not limited to, profile boosts, advanced filters, increased visibility, and the ability to see who liked your profile.

Virtual currency (Coins/Jetons) is purchased with real money and can be used within the Service to access specific features. Virtual currency has no real-world monetary value, cannot be exchanged for cash, and is non-transferable between users.

All purchases of premium subscriptions and virtual currency are final and non-refundable, except as required by applicable law. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

Lushme reserves the right to modify the pricing, availability, and functionality of premium features and virtual currency at any time. Unused virtual currency may expire if your account is terminated for violation of these Terms.

Profile Boost features temporarily increase your profile's visibility to other users. Lushme does not guarantee a specific number of views, matches, or interactions resulting from the use of Boost or any other premium feature.

You are responsible for managing your subscriptions through your app store account (Apple App Store or Google Play Store). Cancellation and refund policies of the respective app stores apply to purchases made through those platforms.

The Service, including all software, design, text, graphics, logos, icons, images, audio, and video content provided by Lushme (collectively, "Lushme Content"), is owned by or licensed to Lushme and is protected by copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or Lushme Content without our express written permission.

The Lushme name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Lushme. You may not use these marks without our prior written permission.

If you believe that any content on Lushme infringes your intellectual property rights, please contact us at support@lushme.app with detailed information about the alleged infringement.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. Please review our Privacy Policy carefully to understand our practices.

You may delete your account at any time through the app settings. Upon deletion, your profile will be removed from the platform, though some information may be retained as required by law or for legitimate business purposes (such as preventing fraud).

Lushme reserves the right to suspend or permanently terminate your account, without prior notice, if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law. We also reserve the right to terminate accounts that are inactive for an extended period.

In the event of termination for violation of these Terms, you will not be entitled to any refund of subscription fees or unused virtual currency. We may also report your conduct to law enforcement authorities if warranted.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Lushme does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any content available through the Service.

Lushme is not responsible for the conduct of any user, whether online or offline. You are solely responsible for your interactions with other users. We strongly recommend exercising caution and good judgment when communicating with or meeting other users, including meeting in public places and informing a trusted person of your plans.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUSHME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL LUSHME'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO LUSHME IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service, you agree to first attempt to resolve the matter informally by contacting us at support@lushme.app. We will attempt to resolve the dispute within thirty (30) days of receiving your notice.

If the dispute cannot be resolved informally, both parties agree to submit to binding arbitration administered by a recognized arbitration body in the jurisdiction where Lushme is established. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or any other representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Lushme.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

Lushme reserves the right to modify these Terms at any time at our sole discretion. When we make material changes, we will notify users through the Service (such as an in-app notification or email) and update the "Last Updated" date at the top of these Terms.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

We encourage you to periodically review these Terms to stay informed about your rights and obligations when using Lushme.
